Pedersoli Studio Legale, in the persons of Manuela Grassi (equity partner) and Luca Traficante (senior associate), obtained a significant success in the defence of a leading banking institution before the Milan Court of Appeal, in the context of a litigation relating to an Interest Rate Swap derivative agreement.

By judgement no. 2352/2023, the Milan Court of Appeal – confirming the first instance judgement in which the defendant bank already obtained a successful outcome – validated the completeness of the intermediary’s contractual and information documents, also in the light of the strict requirements provided for in the subsequent case-law of the Supreme Court Joint Sections, and provided useful clarifications in terms of possible scenarios and mark-to-market.
